1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your use of the My Virtual Closet mobile app and website at myvirtualclosetapp.com (together, the “Service”), operated by “My Virtual Closet” (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least [13] years old, or the minimum age required in your country, to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you confirm that you meet these requirements.

3. Your Account and Profiles

  • You must provide accurate information when you create an account and keep your login details secure.
  • Your plan may allow multiple profiles under one account. Each profile has its own closet, favorites, packing lists, calendar plans and AI suggestions.
  • The person who creates and pays for the account (the “Account Owner”) is responsible for all profiles added to the account and for all activity under it.
  • The Account Owner should only add people who have agreed to use the Service under these Terms.
  • The number of profiles available depends on the subscription package you choose.
  • Notify us immediately at  TanekaDuffin@myvirtualclosetapp.com  if you suspect unauthorized access to your account.

4. Features of the Service

The Service lets you:

  • Upload photos of your clothes and add details such as title, color, brand, category, item type and weather type.
  • Organize clothes into categories and search or filter by color, brand, event or outfit type.
  • Create trips and virtually pack your bag manually or with AI help.
  • Plan outfits for specific dates using the calendar planner.
  • Mark items as donate or sell and generate a list as a PDF.
  • Mark favorites and share them as a PDF.
  • Chat with our AI stylist for outfit suggestions.

We may add, change or remove features at any time.

5. Subscriptions and Payments

  • Access to some or all features requires a paid subscription, billed monthly or yearly depending on the plan you select.
  • Payments are processed by the Apple App Store or Google Play. We do not collect or store your payment card details.
  • Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before renewal through your App Store or Google Play account settings.
  • [If applicable: New users may receive a free trial of [number] days. If you do not cancel before the trial ends, you will be charged the subscription fee.]
  • Prices may change. We will notify you before any change takes effect, and you may cancel before it applies.
  • Refunds are handled under the policies of the Apple App Store or Google Play. Except where required by law, we do not provide refunds for partially used subscription periods.

6. Your Content

  • “Your Content” means the photos, text, details and other material you upload or create in the Service, including AI chat messages and images.
  • You keep ownership of Your Content.
  • You give us a limited, non-exclusive, worldwide license to store, process and display Your Content only as needed to operate, maintain and improve the Service and provide features such as AI suggestions.
  • You are responsible for Your Content. You confirm that you own it or have the right to upload it, and that it does not break any law or anyone’s rights.
  • Do not upload content that is illegal, explicit, hateful, harassing or that shows other people without their permission.

7. AI Suggestions

  • Our AI stylist provides outfit and packing suggestions based on the information and photos you provide and the items in your closet.
  • AI suggestions are for general guidance and inspiration only. They may be inaccurate, incomplete or not suited to your needs.
  • You are responsible for your own clothing and packing decisions. We are not liable for any outcome based on AI suggestions.

8. Donate/Sell Lists and Sharing

  • The Donate/Sell feature helps you create a list of clothes. We are not a marketplace, and we do not buy, sell, ship or handle payments for your items.
  • Any transaction you make with another person is solely between you and them.
  • When you share a PDF list of your clothes or favorites, you decide who receives it. Once shared outside the app, we cannot control who views, copies or forwards it.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Copy, modify, reverse engineer or attempt to extract the source code of the Service.
  • Interfere with or disrupt the Service, its servers or security.
  • Access another user’s account or data without permission.
  • Use bots, scrapers or automated tools to access the Service.
  • Resell or commercially exploit the Service without our written consent.

10. Intellectual Property

The Service, including its design, software, logos, text and AI features, belongs to “My Virtual Closet” or its licensors and is protected by intellectual property laws. These Terms give you a limited, personal, non-transferable right to use the Service. No other rights are granted.

11. Third-Party Services

The Service may rely on third-party services such as app stores, cloud hosting and AI providers. We are not responsible for the content, policies or practices of third parties.

12. Suspension and Termination

  • You may stop using the Service and delete your account at any time.
  • We may suspend or terminate your account if you break these Terms or misuse the Service.
  • After termination, your right to use the Service ends. Cancelling your account does not automatically cancel your subscription with the App Store or Google Play. You must cancel it there.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available”. We do not guarantee that the Service will be uninterrupted, error-free or secure, or that AI suggestions will meet your expectations. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

14. Limitation of Liability

To the fullest extent permitted by law, “My Virtual Closet” and its team will not be liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.

15. Indemnification

You agree to defend and hold us harmless from any claims, losses or expenses arising from Your Content, your misuse of the Service or your breach of these Terms.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email. Continued use after changes take effect means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of [Country/State], without regard to conflict of law rules. Any disputes will be handled in the courts of [Jurisdiction], unless local law requires otherwise.
